7-Year-Old Boy Charged With Rape In Upstate New York

 

A 7-year-old boy was charged with third-degree rape in upstate New York, according to a report released Tuesday.

The child, who is from the sparsely populated Brasher Falls, New York, near the Canadian border, was arrested by state police for an incident that allegedly took place on Thanksgiving, according to local CBS affiliate WWNY. Police did not release much information beyond the fact that he was charged on March 23.WWNY said the child was cited and released, and that the case will be handled in Family Court.

Anthony Martone, who is a defense attorney from Queens that deals with felony youth cases, called the case “absurd.”

“Instinctually, it shouldn’t happen that a 7-year-old — I don’t think you even could really realize what you’re doing at 7 years old. So I think it’s absurd to charge a 7-year-old with rape,” Martone said.“They’d have to prove he actually physically committed this act, which to me it almost seems to be an impossibility,” he added.

Martone maintained that the boy is apparently being charged as a juvenile delinquent, though legislation pending in Albany would change the minimum age for being charged as a juvenile delinquent from 7 to 12.

Young people committing serious crimes has been making headlines recently, perhaps most notably when two teenage girls were charged with felony murder after allegedly carjacking an Uber Eats driver and crashing his car in Washington, D.C. last week. As The Daily Wire reported:

A 66-year-old Uber Eats driver was killed earlier this week when he was thrown from his vehicle after two teenage girls allegedly carjacked him near Nationals Park in southeast Washington, D.C.

Mohammad Anwar died after police say two girls, aged 13 and 15, used a stun gun against him and stole his car before causing it to flip, according to NBC 4 Washington.

The 13-year-old girl is from southeast D.C. and the 15-year-old is from Fort Washington, Maryland, according to police. Their names were not given, but released documents revealed they face felony murder charges and were taken to the Metropolitan Police Department’s homicide branch.

Graphic video taken by a bystander depicts the violent scene, which shows how Anwar fought with the girls before they drove off while he was still attached to the vehicle. They crash the car, and the video later shows Anwar’s body on the sidewalk as National Guardsmen help the girls out of the flipped vehicle. One of the girls can be heard saying something about her phone.

After Anwar’s death, Washington, D.C., Mayor Muriel Bowser tweeted advice for District residents to avoid auto theft, which she claimed was “a crime of opportunity.” Some claimed the tweet was in poor taste given the multiple carjackings that took place in the District last week. In addition to Anwar’s death, two teenage boys, aged 13 and 14, were arrested in another carjacking incident last Thursday.

Bowser later yanked the tweet after facing furious backlash.
