Ira Judelson said that Jeffrey Epstein's alleged madam will have to significantly increase the $5million bail package she is offering.
She will have to come up with different properties to back it up as Manhattan's federal court will not accept the $3.75million of homes in the UK.
Judelson said that if Maxwell does get bail, prosecutors will put cameras in the home where she is staying so they can monitor her 24/7 - and will remove all the knives for her own protection.
Maxwell is due to appear in federal court in New York Tuesday where a judge will decide if she gets bail.

The 58-year-old British socialite is accused of being Epstein's madam and arranging girls as young as 14 for him to abuse.
She has said she will 'vigorously' defend herself against the allegations.

Judelson has arranged bonds for the likes of disgraced movie mogul Harvey Weinstein and Dominic Strauss-Kahn, the former head of the International Monetary Fund who was accused of raping a hotel maid in New York in 2011.
His other clients include rappers Old Dirty B******, Ja Rule, DMX, 'Manhattan Madam' Kristin Davis and retired UFC fighter Conor McGregor.
Speaking to DailyMail.com, Judelson said that Maxwell's bail bond could top that of Epstein after his arrest last July.
The pedophile's lawyers offered a $77million package including his New York mansion, his private jet and another property as collateral.
Judelson said: 'There is no way that $5million is going to be enough for Maxwell. In my opinion she's a flight risk.
'I could see the judge asking for $5million cash, $25million in property as part of a $100million bond, but not what they've offered.
'They're not going to accept properties outside the U.S. either. The U.S. government can't attach a property to a bond if it's not in America and that's when a guy like me comes in.
'I've done some of the guys from the FIFA soccer corruption cases and they had properties in the Caribbean, and that wasn't allowed'.

Maxwell was arrested on July 2 at her $1million home called 'Tuckedaway' in the rural town of Bradford, New Hampshire.
Maxwell's lawyers said that the $5million bond would be co-signed by two of her sisters and friends backed up by more than $3.75million in UK property.
She would be confined to a home in the New York area, surrender all her travel documents and be subject to GPS monitoring.
But that is assuming that she can find somewhere for her to stay, Judelson said.
After Strauss-Kahn was given bail, which a judge set at $1m, he was confined to a $14m townhouse in Tribeca in New York which was dubbed his 'gilded cage'.
Judelson said that nobody wanted to loan Strauss-Kahn their property so he had to call in a favor from a realtor he knew.
Maxwell could face similar problems and he advised that the 'have a property lined up already', Judelson said.
He said: 'The government is going to want to have a good look around inside and if they are OK with it, they are going to bring in a camera system so they can keep an eye on her.
'They will make sure she is safe and will do things like removing the knives from the kitchen'.

Judelson said that he has not yet received a call from Maxwell's lawyers but would not be surprised if he got one at the last minute.
He said: 'One of her lawyers is a former prosecutor who helped put El Chapo away, but I think they need to start being more creative.
'She may have an argument about catching the coronavirus while in jail and it's costing the government a lot of money to keep her inside and protected so they may want to put some of the cost back on her'.
Maxwell is currently being held at the Metropolitan Detention Center in Brooklyn which a former warden has called one of the 'most troubled' jails in the federal prison system.
